Terms of Service

These Terms of Service ("Terms") govern your use of consultingapp.io ("the Service"), operated by consultingapp Inc. ("we," "us," "our"). By creating an account or using the Service, you agree to these Terms.

Your Data, Your Property

You retain full ownership of all content you upload, create, or generate on consultingapp.io — including documents, simulation results, reports, frameworks, financial models, and any other outputs. We do not claim any intellectual property rights over your content. We do not use your content to train AI models, and we never sell, license, or share your data with third parties except as required to operate the Service (see our Privacy Policy).

1. Account Terms

  • You must be at least 16 years old to use the Service.
  • You must provide accurate account information and keep it current.
  • You are responsible for maintaining the security of your account credentials. We recommend enabling two-factor authentication.
  • You are responsible for all activity that occurs under your account.
  • One person or legal entity may maintain no more than one free account.

2. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation.
  • Upload content that infringes on the intellectual property rights of others.
  • Attempt to gain unauthorized access to the Service or its infrastructure.
  • Use automated tools to scrape, crawl, or extract data from the Service beyond what is available through our API.
  • Resell, redistribute, or sublicense the Service without written permission.
  • Interfere with or disrupt the integrity or performance of the Service.

3. Billing & Subscriptions

  • Free tier: No credit card required. Subject to usage limits described on our pricing page.
  • Paid plans: Billed monthly or annually through Stripe. Prices are in USD.
  • Upgrades: Take effect immediately. You will be charged a prorated amount for the remainder of the billing period.
  • Downgrades: Take effect at the end of the current billing period.
  • Cancellation: You may cancel at any time through Settings → Billing. Your subscription remains active until the end of the paid period. Data is retained for 90 days after cancellation.
  • Refunds: We offer a full refund within 14 days of your first paid subscription if you are unsatisfied. After that, refunds are at our discretion. Contact us at our support page.

4. Service Availability

  • We strive to maintain 99.9% uptime but do not guarantee it for non-Enterprise plans.
  • We may perform scheduled maintenance with reasonable advance notice.
  • Enterprise customers receive a separate SLA with defined uptime guarantees and support response times.
  • We reserve the right to modify or discontinue features with 30 days' notice for material changes.

5. API Usage

  • API access is available on Team and Enterprise plans.
  • API keys are secret credentials — do not share them publicly or embed them in client-side code.
  • API usage is subject to rate limits defined by your plan tier.
  • We may revoke API access for abuse or violation of these Terms.

6. Intellectual Property

  • Your content: You own it. We have a limited license to process, store, and display it only as needed to provide the Service to you.
  • Our platform: The Service, including its software, design, documentation, and branding, is owned by consultingapp Inc. and protected by intellectual property laws.
  • Feedback: If you submit feature suggestions or feedback, you grant us a non-exclusive license to use it to improve the Service without obligation to you.
  • Open source: Our simulation engine is open source under the MIT license. Platform-specific code is proprietary.

7. Limitation of Liability

To the maximum extent permitted by law, consultingapp Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising from your use of the Service.

Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

The Service provides analytical tools and AI-generated insights. These are not substitutes for professional judgment. You are responsible for decisions made using outputs from the platform.

8. Termination

  • You may close your account at any time through Settings.
  • We may suspend or terminate accounts that violate these Terms, with notice when practical.
  • Upon termination, your data is retained for 90 days to allow export, then permanently deleted.

9. Changes to These Terms

We may update these Terms from time to time. For material changes, we will notify you via email at least 30 days in advance. Continued use of the Service after changes take effect constitutes acceptance.

10. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.
